Non-Refundable Deposit: Work on any project only commences once a non-refundable deposit of 50% has been paid. This secures your time and covers initial costs.
Final Payment: The remaining 50% is due immediately upon project completion and before the website is transferred to the client’s live domain or handed over.
2. The “Varsity Shield”: Project Timelines
Client Delays: You are not responsible for deadlines missed because the client didn’t send photos or text.
The Clause:“If the client fails to provide necessary content within 14 days, the project will be moved to the end of the current production queue.” (This protects you during exams!).
Student Status:“Client acknowledges that Buildev is operated by a sole proprietor who is also a full-time student. While every effort is made to meet deadlines, peak academic periods may result in minor timeline adjustments with prior notice.”
3. No More “Quick Tweaks”: Revisions & Scope
The Limit: Every project includes exactly two (2) rounds of revisions.
Scope Creep: Anything not listed in the initial quote is an “Extra.”
The Clause:“Any work requested outside the original ‘Growth System’ or ‘Professional Footprint’ package will be billed at a standard hourly rate of R650/hour.”
4. Ownership & “The Kill Switch”
Intellectual Property: You own the code and design until the final cent is paid.
Right to Display: You reserve the right to display the work in your portfolio (great for getting your next client).
Suspension of Service: If a monthly retainer (Service 3) is not paid within 7 days of the due date, you have the right to suspend the website or “Priority WhatsApp” support.
5. POPIA & Legal Compliance
Data Protection: You will handle client data according to the Protection of Personal Information Act.
Limitation of Liability: You are not liable for any business loss, lost profits, or server downtime. You build the tool; the client is responsible for how they use it.
